These Terms of Service (the “Terms”) govern your access to and use of the pet photography services, website, booking systems, communications, galleries, deliverables, and related offerings provided by Maple Paw Photography Ltd. (“Maple Paw Photography Ltd.,” “we,” “us,” or “our”). By booking, purchasing, accessing, or using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or make a booking with Maple Paw Photography Ltd.
1. Introduction and Acceptance of Terms
These Terms form a legally binding agreement between you and Maple Paw Photography Ltd. regarding the provision of photography services for pets and related sessions. By submitting an inquiry, booking a session, paying an invoice, signing a contract, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.
If you are booking on behalf of another person, you represent and warrant that you have authority to bind that person to these Terms.
2. Scope of Services
Maple Paw Photography Ltd. provides pet-focused photography services, which may include, without limitation:
- Pet portrait photography
- Outdoor lifestyle pet sessions
- Studio photo sessions for dogs, cats, and small animals
- Owner and pet family portraits
- Puppy and kitten milestone sessions
- Holiday and seasonal pet mini sessions
- Pet memorial portrait sessions
Specific session details, included deliverables, session duration, editing style, location, number of images, print products, usage rights, and fees may vary depending on the package selected and any written agreement, invoice, or booking confirmation issued by Maple Paw Photography Ltd.
We reserve the right to determine, in our professional discretion, the suitability of animals, locations, lighting, weather, and safety conditions for each session. We may refuse or terminate a session if, in our judgment, circumstances create a risk to persons, animals, property, or equipment.
3. User Obligations and Responsibilities
You agree to comply with all instructions, policies, and safety requirements provided by Maple Paw Photography Ltd. during the booking process, at the session, and in any pre-session communications.
You are responsible for:
- Providing accurate, complete, and current information when booking or communicating with us
- Ensuring that all animals attending the session are healthy, properly supervised, and appropriately controlled
- Disclosing any behavioral issues, aggression, anxiety, reactivity, medical concerns, or special handling needs in advance
- Ensuring that collars, harnesses, leashes, and other accessories are safe and appropriate for the session
- Bringing any required supplies, treats, toys, cleanup materials, water, or comfort items for your pet
- Complying with applicable animal control laws, leash requirements, park rules, and venue policies
- Ensuring that all minors are supervised by a responsible adult at all times
You acknowledge that pet photography may involve risks, including but not limited to animal behavior, environmental hazards, transportation, outdoor terrain, weather conditions, and interaction with people, animals, or objects. You assume all ordinary and inherent risks associated with participation in a photography session to the fullest extent permitted by law.
You agree that you will not bring to a session any animal that is sick, infested, untreated for parasites, or otherwise unsafe for contact with people or other animals, unless prior written arrangements are made and expressly approved by Maple Paw Photography Ltd.
You are responsible for obtaining any permits, permissions, or approvals required for a location that you request, unless otherwise agreed in writing.
4. Payment Terms and Conditions
All prices are listed in Canadian dollars unless otherwise stated. Taxes, fees, travel charges, location fees, product fees, rush fees, and other applicable amounts may be added where appropriate and in accordance with the applicable invoice or booking agreement.
Payment terms may include one or more of the following, as stated at the time of booking:
- A non-refundable retainer or booking deposit
- Partial prepayment
- Full payment in advance
- Payment upon delivery of proofs, images, or products
Your session is not confirmed until any required deposit or payment has been received and, where applicable, a booking confirmation has been issued by Maple Paw Photography Ltd.
If an invoice remains unpaid by the due date, we may suspend services, delay delivery, cancel the booking, and/or apply late fees to the extent permitted by law and as stated on the invoice or booking agreement. You are responsible for any collection costs or bank charges arising from failed payments, chargebacks, reversed transactions, or returned payments, except to the extent caused by our error.
Unless otherwise agreed in writing, session fees do not include unselected digital files, printed products, albums, wall art, or third-party vendor charges.
5. Cancellation and Refund Policy
Because we reserve time, prepare equipment, and may decline other bookings, deposits and retainers are generally non-refundable, except where required by applicable law or expressly stated otherwise in writing by Maple Paw Photography Ltd.
If you need to reschedule, you must provide notice as early as possible. Rescheduling is subject to availability and may be limited by seasonal demand, weather, or venue constraints. Additional fees may apply for repeated rescheduling, short-notice changes, travel changes, or special accommodations.
If you cancel a session, any refund, credit, or partial refund will be determined according to the booking terms provided at the time of purchase and subject to applicable law. In general:
- Deposits and retainers are not refundable
- Digital or product orders already completed, edited, ordered, or delivered are not refundable
- Custom products, prints, albums, and third-party items are non-cancellable and non-refundable once production has started
If a session must be postponed or canceled due to unsafe weather, illness, venue restrictions, emergency, or other circumstances beyond our control, Maple Paw Photography Ltd. may offer a rescheduled date or credit at our discretion. We are not responsible for incidental expenses incurred by you, including travel, lodging, grooming, or veterinary costs.
If we must cancel a session for reasons within our control, our liability will be limited to rescheduling the session or refunding amounts paid for the canceled session, as determined by applicable law and the specific circumstances.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Paw Photography Ltd. and its directors, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, emotional distress, or loss of opportunity, arising out of or relating to the services.
Without limiting the foregoing, we are not liable for:
- Injuries to pets, persons, or third parties arising from animal behavior or participation in a session
- Damage to property occurring during a session unless caused by our gross negligence or willful misconduct
- Delays, missed shots, limited output, or inability to complete a session due to weather, animal behavior, equipment failure, location restrictions, or circumstances beyond our control
- Loss or corruption of images due to technical failure, theft, fire, power outage, accident, or similar events, except as required by law
- Third-party actions, including venue operators, printers, shipping providers, or social media platforms
Our total aggregate liability for any claim arising from or related to the services shall not exceed the amount paid by you to Maple Paw Photography Ltd. for the specific session or product giving rise to the claim, except where such limitation is prohibited by law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or any liability that cannot lawfully be limited in Canada.
7. Intellectual Property Rights
All photographs, images, proofs, edited files, previews, concepts, designs, workflows, session materials, and related creative works created by Maple Paw Photography Ltd. remain the intellectual property of Maple Paw Photography Ltd. unless otherwise expressly agreed in writing.

Maple Paw Photography Ltd. may use photographs and related content for portfolio, marketing, website, social media, print promotion, competitions, and similar business purposes, subject to any express written opt-out or other written agreement with you.
